    Almost 12,600 U.S. real estate sales associates from every state are featured. All production numbers are independently verified by a third-party to ensure accuracy and report integrity.

    Deed of Trust – What You Need to Know on Trust Deeds

    Deed of Trust

    A trust deed or a deed of trust is an instrument in writing that lays down the terms and conditions of a trust agreement. A trust deed is a contract entered into between a lender and a borrower to secure payment of the borrower’s debt by transferring an interest in the borrower’s land to a third party known as a trustee. Deeds of trust authorize the trustee to sell trust property if the borrower fails to pay the debt.

    Parties to a deed of trust are:

    • a borrower who gives the legal title of a real property to the trustee
    • a lender or a beneficiary who gives the loan
    • a trustee or a grantor who holds property for the benefit of the lender

    There are different types of trust property deeds:

    • Warranty deeds – a warranty deed transfers ownership free of liens.
    • Grant deed – it transfers ownership with a guarantee that the property is not already transferred.
    • Quitclaim deed – it transfers only the rights of a transferring party on the property.

    A deed of trust is similar to a mortgage. However, in a mortgage there is an actual transfer of title to the lender, whereas title is not transferred in trust deed. Mortgages are generally related with loans secured on real estate.

    Many jurisdictions allow second and third trust of deeds or mortgages. A second mortgage or trust deed is a mortgage that is second in priority to another mortgage. The lender of a second mortgage loan holds a junior security interest in the real property.

    When a loan is paid in full, a lender can request the trustee to return property by reconveyance. This can be done with the help of a deed of reconveyance. A reconveyance deed is an instrument issued by a lender to a borrower where the lender officially certifies that s/he is releasing claim on the property. A reconveyance deed is also known as release of mortgage document or release of deed of trust document. When a loan is fully paid, a satisfaction of mortgage is recorded with the register of deeds in the county records.

    If a loan is in default, a lender can file a notice of default. After issuing notice of default to the borrower, a trustee can commence foreclosure by power of sale. In a foreclosure sale by trustee or trustee’s sale, the trustee auctions the property to the highest bidder. A transfer or sale of real estate is made by preparing and recording a trust transfer deed. After the sale, a borrower can buy back the property within a stipulated period by paying the auction price plus interest and other charges. This right is known as a right of redemption.

    Lenders of mortgages or trust deeds can assign mortgages to other lenders. When an assignment of mortgage is made, the assignee gets all rights of the original lender. In order to provide a valid notice of assignment, the assignment must be in writing and recorded in the records of the county where the property is situated.

The person who makes the deed transfer is called an assignor and the person to whom the mortgage is assigned is known as an assignee.     Plaintiffs have time limits for filing civil lawsuits, which differ by the type of claim (in most states). These time limits, referred to as the civil statute of limitations. are meant to help preserve the integrity of evidence and witness testimony.

    Statutes of limitations are enacted to ensure that claims are made while evidence is still relatively vital, and to prevent the constant threat of a lawsuit long after the disputed event has occurred.Arizona’s civil statute of limitations laws provide a two-year time limit for personal injuries; but just a one-year limit for libel/slander.

    There are times, of course, when there is no way to reasonably know for certain that an injury has occurred. Other times you may not realize the cause of a known injury until much later. Take, for example, a cancer diagnosis caused by workplace pollution. That may not become known for a many years after exposure. Or a long-time black employee may not have found out that she was being discriminated against until several years after the fact.

    There are also instances in which the statute of limitation may be tolled — or paused — for a period of time. This may happen if the plaintiff was a minor (under 18) or mentally incompetent at the time the injury occurred. Also, statutes of limitation may also be shortened through contract.

In early 1986, CALC became a totally online school through its Tutoring Center on the QuatumLink network, and followed with structured courses in 1986. From 1986 through 1995, CALC Online Campus, as it was known, opened its online school on several major telecommunications networks, including PC-Link, AppleLink, AOL, Delphi, GEnie, and CompuServe. In early 1995, CALC Online Campus made its online school available through the Internet as CALCampus.com and after receiving regional accreditation, the domain changed to calcampus.edu. Since 1986, CALCampus has been in continual operation as an online school and we have been pleased to see the increasing adoption of online education by the mainstream educational community over the decades.

    The retirement industry has been steadily growing over the past twenty years. The percentage of the U.S. population over the age of 55 is at an all time high of 21% and is growing at an average rate of 3% each year. Banks are taking ownership of real estate by way of foreclosure and then offering to sell foreclosed properties at drastically reduced prices adding low priced supply to a market that already has too much supply and not enough demand.

    Many property owners continue to make loan payments on underwater mortgages without a careful analysis of their options. Homeowners are depleting all available savings, liquidating retirement accounts and investment accounts, delaying the payment of critical federal and state tax liabilities, selling assets, borrowing money from family and friends all in a valiant effort to remain current on their real estate loans. These decisions make a bad situation much worse. Too many borrowers are limiting their options by waiting too long to seek legal and financial advice concerning their real estate loans.     Golden Valley Real Estate, LLC (GVRE) is a start-up company in the Tucson area. It is the mission of GVRE to provide real estate services in the newly established Golden Valley Retirement Community, located to the Northwest of scenic Tucson, Arizona. GVRE is a full service real estate, mortgage, and title company.

    The Company
    GVRE will be a limited liability partnership registered in the state of Delaware for tax purposes. Its founder is Mrs. Susan Egan, a former agent for RE/MAX real estate company, where she worked for 23 years.

    The company plans to be leveraged through private investment and a limited number of loans. The company expects to begin offering its services in June.

    The company’s main clients will be retirement age couples looking for a community that can offer significant services for their age group and income levels. Since Mrs. Egan is within this demographic group and knows and understands this market’s needs, she believes that she can appeal to such clients far more than most other competitors.

    The Services
    GVRE offers comprehensive real estate, mortgage and title services to our diverse clients.     The Market
    The retirement industry has been steadily growing over the past twenty years. The percentage of the U.S. population over the age of 55 is at an all time high of 21% and is growing at an average rate of 3% each year. In certain parts of the country like the American Southwest, which has a high concentration of retirement communities, the growth rate is about 8%. This percentage is also expected to grow as the first of the “baby boomer” generation begins to reach retirement age in the next decade. It is estimated by the U.S. Census Bureau that the retirement industry, that includes homes, medical facilities, specialty equipment, retirement entertainment services, etc. accounts for 4.8 billion dollars each year.

    Financial Considerations
    Start-up expenses and funding required are modest. They include expenses and the rest in cash needed to support operations until revenues reach an acceptable level. Most of the company’s liabilities will come from outside private investors and management investment, however, we have current borrowing from Bank of America Commercial Investments, the principal to be paid off in two years. A long-term loan through Valley National Bank will be paid off in ten years.

    The company expects to reach profitability in the first year and does not anticipate any serious cash flow problems. We conservatively believe that during the first three years, average profitability per month per segment will be adequate. We expect that about one sale per month will guarantee a break-even point.
