The standard of care is the protocol the medical professional is expected to follow in order to provide the proper care required by a patient. When a medical professional doesn’t meet this standard of care and doesn’t follow accepted and required protocol, they may be acting negligently. Common Causes of Medical Malpractice

    New Jersey Inheritance Tax

    New Jersey is one of only a few states that impose both an inheritance tax and a state estate tax. The inheritance tax is applies when someone who lived in New Jersey, or owned property there, leaves property to someone who isn t a close relative. The tax rate depends on how closely the inheritors and deceased person were related.

    How Inheritors Are Categorized

    New Jersey law puts inheritors into different groups, based on their family relationship to the deceased person.

    Class A beneficiaries are exempt from the inheritance tax. They includes the deceased person s:

    • spouse, domestic partner, or civil union partner
    • parent or grandparent
    • child (biological, adopted, or mutually acknowledged)
    • stepchild (but not stepgrandchild or great-stepgrandchild)
    • grandchild or other lineal descendant of a child

    Class B was deleted when New Jersey law changed.

    Class C includes the deceased person s:

    • brother or sister
    • spouse or civil union partner of the deceased person’s child
    • surviving spouse or civil union partner of the deceased person’s child

    The first $25,000 of property inherited by someone in Class C is not taxed. On amounts exceeding $25,000, the tax rates are:

    Class D includes everyone else. There is no special exemption amount, and the applicable tax rates are:

    Class E includes the State of New Jersey or any of its political subdivisions for public or charitable purposes, an educational institution, church, hospital, orphan asylum, public library, and some other nonprofit agencies. These beneficiaries are exempt from inheritance tax.

    Other Inheritance Tax Exemptions

    Other tax exemptions apply to all beneficiaries, in every legal classification. The New Jersey inheritance tax is not collected on:

    • Transfers of less than $500
    • Life insurance proceeds paid to a named beneficiary
    • Charitable transfers for the use of an educational institution, church, hospital, public library, and so on
    • Payments from the New Jersey Public Employees Retirement System, the New Jersey Teachers Pension and Annuity Fund, or the New Jersey Police and Firemen’s Retirement System
    • Federal Civil Service Retirement benefits payable to a beneficiary other than the deceased person s estate
    • Annuities payable by the U.S. government under the Retired Serviceman s Family Protection Plan or the Survivor Benefit Plan to a beneficiary other than the estate

    Gifts Made During Your Lifetime

    If you make gifts in the three years before your death, those gifts are also subject to New Jersey inheritance tax, unless the recipients are exempt under the rules discussed above. They aren’t taxed, however, if it can be proved that you didn’t give away the money or property “in contemplation of death.”

    Filing the Inheritance Tax Return

    It s the job of the personal representative (executor or administrator) of the estate to file an inheritance tax return. Only one return needs to be filed, even if several people owe inheritance tax.

    New Jersey inheritance tax returns (Form IT-R, if the deceased person was a New Jersey resident), instructions, and current tax rates are available on the state Division of Taxation website. The tax return, along with copies of the will (if any) and the deceased person s last federal income tax return, is filed with the New Jersey Division of Taxation. The return must be filed, and any tax paid, eight months from the date of death. Interest accrues on any unpaid tax. The state can grant an extension of up to four months to file the return, but the tax must still be paid by the original deadline.

    Inheritance Tax Waivers

    Certain property can t be transferred out of the estate until the inheritance tax is paid and the state issues a tax waiver. If no tax is due, someone who is a Class A beneficiary can file a Request for Real Property Tax Waiver. If the waiver is granted, an inheritance tax return doesn t have to be filed.

    Prestigious Brearley School Looks Into Past Sexual Abuse

    The elite Brearley School in Manhattan, known for sending its students to the top universities in the country, said it was looking into allegations of sexual misconduct.

    The school said no students or families had raised concerns about sexual misconduct, but that Brearley was “recently made aware of possible sexual misconduct not related to current faculty or staff that occurred in the distance past.”

    “It hurts, saddens me, makes me angry, but does it surprise me? No,” said Chris Thompson.

    Founded in 1884, the all-girls school on the Upper East Side has about 700 students enrolled between kindergarten and 12th grade. Among its notable alumni are Caroline Kennedy, actress Téa Leoni and Katharine Weymouth, a past publisher of The Washington Post.

    “I went to a boarding school, and they had a number of incidents, and it’s just too bad,” Charlie Strout, of the Upper East Side, said.

    “The schools are really good schools and you hear these things about these isolated people, and it sort of reflects badly on the whole school,” he said.

    In the letter sent home to parents, the school says that “regardless of the time that has elapsed, it is our absolute responsibility to care for all of our alumnae.”

    The school said attorneys “have been engaged to conduct an investigation of any reports of such misconduct at Brearley.”

    The letter comes about a month after an elite boarding school in Wallingford, Connecticut, released a report detailing decades of alleged sexual abuse of students that went unreported or was handled quietly.

    The school said students were made aware of the investigation in class, in an age-appropriate manner.

    It’s asking anyone from the Brearley community, current and former students and parents, to come forward with any information as they investigate the allegations.

    When it comes to obtaining car insurance in New Jersey, you have options. New Jersey offers several avenues for you to fulfill the state’s car insurance requirements. Read more to learn about rates, policy options, and how to get the best car insurance quotes in New Jersey.

    Car Insurance Requirements in NJ

    In order to comply with New Jersey’s car insurance laws, you must choose a car insurance policy. Basic and standard policies are available; you should choose whichever policy best suits your insurance and financial needs.

    Basic Policy

    The Basic policy option is the more affordable insurance package; however, it offers limited coverage. including:

    • $5,000 of property damage liability (PDL) per accident. This covers damage you may have caused to someone’s property in a car crash.
    • $15,000 of personal injury protection (PIP) per person, per accident. This coverage pays for injuries you suffer in a car crash.
    • Up to $250,000 for very severe injuries. such as permanent brain injuries.

    NOTE. Bodily injury liability (BDL) coverage is not included in the Basic policy; however, policyholders are offered the option to purchase $10,000 of BDL coverage.

    Standard Policy

    The Standard policy option has a higher premium but offers more extensive coverage.

    With the Standard policy, you get a minimum of:

    • $15,000 of bodily injury liability (BDL) insurance per person, per accident. This coverage will pay for injuries to anyone not in your car if you cause a car crash.
    • $30,000 of BDL for multiple injured people per accident.
    • $5,000 of PDLper accident.
    • $15,000 of PIP per person in a car accident.
    • Up to $250,000 of PIP for severe or permanent injuries .

    If you choose to purchase the Standard policy, you will have to make a decision on your right to sue if you are injured in a car accident.

    Regardless of which right to sue option you choose, you will not be eligible to sue for medical expenses or loss of income, as both of those will be covered by your PIP; you can only sue for pain and suffering.

    If you choose the unlimited right to sue option, you can sue a person who caused an accident you were injured in.

    Because this is option offers broader rights to sue, it comes with a higher premium.

    If you choose the limited right to sue option, you agree to only sue a person who causes a car accident if you suffer any of the following injuries.

    • Loss of a body part.
    • Significant disfigurement.
    • Significant scarring.
    • Displaced fractures.
    • Loss of a fetus.
    • Permanent injury.
    • Death.

    The limited right to sue option is the more affordable of the right to sue options, and is the only option available in the Basic policy plan.

    PIP and Health Insurance

    You have the option of making your health insurance the primary source of medical insurance after a car accident. If you are on Medicaid or Medicare, this option is notavailable to you.

    If you choose to have your health insurance as your primary insurance over personal injury protection (PIP), your health insurance will pay for your medical care after an accident up to your policy’s limits. Your PIP will help pay for further costs.

    Choosing this option will lower your car insurance premium. However, before you make this decision, make sure your health insurance covers injuries due to car accidents.

    You might also want to compare your health insurance deductible – the part of your insurance coverage you are responsible for – to your PIP deductible .If your health insurance deductible is higher. then consider making your PIP your primary source of insurance for accident-related medical expenses.

    Optional Car Insurance

    In addition to the Basic and Standard car insurance options, most New Jersey auto insurance carriers also offer the following optional types of coverage:

    • Comprehensive – This coverage protects you against damages done to your car that do not involve car accidents, such as vandalism or damage caused by bad weather.
    • Collision – This coverage will help pay for damages to your car that result from an accident with another moving car.
    • Towing and labor coverage .
    • Rental car coverage.

    NOTE: Comprehensive and collision coverages are not required by New Jersey law; however, if you’re paying a car loan or lease, your finance company will require you to purchase these types of coverage.

    Special Automobile Insurance Policy

    If you are enrolled in Federal Medicaid with hospitalization, you are eligible for New Jersey’s Special Automobile Insurance Policy (SAIP), which helps people who might not be able to afford standard car insurance purchase a low-cost car insurance policy.

    Through SAIP, you will only be covered for medical costs after a car accident.

    An SAIP car insurance policy costs $365 per year if you choose to pay in 2 installments, or $360 per year if you pay for the entire year up front.

    You can apply to SAIP through most New Jersey car insurance companies, but if you would like help, you can call the Personal Automobile Insurance Plan (PAIP) at (800) 652-2471.

    Car Insurance Fraud in New Jersey

    New Jersey takes insurance fraud very seriously. Possible car insurance fraud may involve:

    • Faking injuries after a car accident.
    • Medical professionals overcharging for treatment of injuries.
    • Staging car crashes.
    • Making or having false car insurance ID cards.

    Fines and Penalties

    Car insurance fraud convictions can lead to:

    • Jail time.
    • Up to $15,000 in fines.

    Reporting Car Insurance Fraud

    If you know of any suspected car insurance fraud, you can report tips to the New Jersey Office of the Insurance Fraud Prosecutor (OIFP):

    Rewards Program

    The OIFP offers a rewards program for individuals who report fraud, but only if the tip leads to an arrest and criminal conviction. Also, in order for the reward to be payable, the tip must be new, meaning the case cannot already be under investigation.

    Just about everybody knows that over the past few years our economy has been in a significant downtrend. Expansive and sometimes very expensive homes were bought with very little money down and they have since lost a substantial portion of their former value. Home owners have lost their jobs, forced to accept lower compensation, and small business owners have seen their income slashed. It’s no wonder why so many of our neighbors are facing foreclosure.

    Before you decide what Foreclosure Defense strategy might work best for you, it is important that you have a basic understanding of New Jersey Foreclosure laws.

    New Jersey Mortgage and Foreclosure Law Primer

    • In New Jersey is a Lien Theory State in which the property acts as security for the loan. The document which is considered the lien is called the Mortgage
    • In order for the lender to begin foreclosure proceedings he must file with the Superior Court in what is known as a Judicial Foreclosure . Foreclosures are handled within the Superior Court by their Foreclosure Unit .
    • The filed Foreclosure Complaint must be accompanied with a Lis Pendens , which is documentation that proper public notice has been given on the property that is being foreclosed.
    • The length of time it takes to foreclose is dependent on the court’s schedule. New Jersey has one the longest waits. It normally takes about 250 days for an uncontested foreclosure. This can be further delayed if the home owner contests the action, files petitions for delays, or files for bankruptcy.
    • The Home owner has 35 days to file an answer to the Foreclosure Complaint. If this is not done the home owner will be considered in default.
    • Once a default is declared, the lender must wait another 45 days before the court’s final judgment is issued and a Writ of Execution is issued and sent to the local Sheriff’s office to start the foreclosure sale process.
    • The home owner in default must be given a minimum of 10 days notification before the foreclosure sale can occur.
    • The State of New Jersey has a Right of Redemption Statue which allows a foreclosed home owner to reclaim his property by paying the full amount of the unpaid loan plus costs. The law gives the party 10 days to redeem the home after the foreclosure sale.
    • New Jersey allows for a Deficiency Judgment which can be applied if the property is sold at public sale for less than the balance owed. This means the borrower is still held responsible for the difference. Fortunately New Jersey has the Fair Market Credit doctrine where, in such cases of low or minimal bids, gives due credit to the borrower, at the Fair Market Value value of the home.
