However, legal help is a cost of doing business that often saves you money and helps your business in the long run.

While you certainly don’t need an attorney for every step of running your business, an ounce of prevention is worth a pound of the cure. This article will explain when you can cover legal issues on your own or with minimal attorney assistance and when you will definitely need a business lawyer.

Issues You Can Handle on Your Own

There are certain matters that are fairly straightforward and/or not unduly difficult to learn and therefore do not require the services of an attorney who charges at least $200 per hour. There are enough expenses associated with running a business, why not save yourself a load of money and do it yourself if you can?

The following is a list of some tasks that business owners should consider taking on themselves (with the aid of self-help resources, online and in print):

Most of the issues outlined above can be handled by any intelligent business owner (if you can run a business, you can certainly fill out IRS forms or fill in boilerplate business forms). There are times, however, when a business faces issues that are too complex, too time consuming, or fraught with liability issues. At that point,the wisest move is to retain a business lawyer.

A few examples include:

  • Former, current, or prospective employees suing on the grounds of discrimination in hiring, firing, or hostile work environment
  • Local, state, or federal government entities filing complaints or investigating your business for violation of any laws.
  • You want to make a special allocation of profits and losses or you want to contribute appreciated property to your partnership or LLC agreement
  • An environmental issue arises and your business is involved (even if your business didn’t cause the environmental problem, you may be penalized)
  • Negotiating for the sale or your company or for the acquisition of another company or its assets

An Ounce of Prevention

While you certainly need to retain an attorney for the serious issues above, your emphasis should be placed on preventing such occurrences in the first place. Prevention does not necessarily involve hiring an attorney, though consulting with one wouldn’t hurt. By the time you or your business is sued, the preventable damage has been done and the only question that remains is how much you’ll be paying in attorney’s fees, court fees, and damages.

For example, by the time a prospective employee files a lawsuit claiming gender discrimination based in part upon questions posed at the job interview, all you can do is hire an attorney to defend the lawsuit. If, on the other hand, you had done your own research on anti-discrimination laws, or you had consulted an attorney beforehand, you would have known not to inquire as to whether the applicant was pregnant or planned on becoming pregnant. The small effort at the beginning of the process would save you an enormous headache later.

To prevent unnecessary attorney costs at the inception of your business as well as tremendous costs after a lawsuit has been filed, you might consider a consultation arrangement with an attorney. Such an arrangement would entail you doing most of the legwork of research and the attorney providing legal review or guidance.

For example, you might use self help and online sources to create a contract with a vendor and ask an attorney to simply review and offer suggestions. Or from the previous example, you might research types of questions to ask during an interview and then send the list to an attorney for his or her approval. This way, you prevent the potential headache later and the cost to you is minimal because you’ve already done most of the work and the attorney simply reviews the document.

    A lawyer helps individuals resolve legal disputes. To do so, they may conduct research, write legal documents, argue a client’s case before a court, or negotiate settlement terms. A business lawyer is an attorney who focuses his or her legal practice on issues that affect businesses, such as taxation, various types of business transactions, and intellectual property.

    Almost all lawyers work primarily from offices on a full-time basis. Most lawyers will have to work longer hours at some point, often in preparation for a case. The education path to becoming a business lawyer is long, requiring passage of law school and the bar exam. But there is potential for high income. According to the U.S. Bureau of Labor Statistics, lawyers earned an average salary of $115,820 as of May 2015. Keep in mind that individuals working for private law firms, especially in the world of business, often make more money than some of their counterparts.

    Now let’s walk through the steps you need to take to become a business lawyer.

    Step 1: Earn an Undergraduate Degree Program

    The majority of law schools require applicants to have earned a bachelor’s degree. There is no specific major that aspiring lawyers must study, but many earn their degrees in economics, government, history, or related fields. Aspiring business lawyers may consider completing a bachelor’s degree program in business or business administration, so they are familiar with the basics of business operations.

    Step 2: Take the LSAT Exam

    Law school applicants must take the Law School Admission Test (LSAT) and submit their scores with their applications. Most students take the LSAT during their junior year of undergraduate study. This exam tests an examinee’s logical thinking and analytical reasoning skills.

    Before sitting for the LSAT, be sure to prepare for the exam. Admission to law school is competitive and may depend largely on an applicant’s GPA and LSAT score. Preparing for the LSAT exam by completing a prep course, which often includes practice exams, may increase an examinee’s score.

    Step 3: Graduate from Law School

    Law school typically requires three years of full-time study. At the end of those three years, graduates are awarded a Juris Doctor degree. During the first year of study, law students complete classes in basic law subjects, such as property, contracts, torts, and civil law. In their second and third years of study, students complete elective classes and may also participate in judicial internships.

    Some law schools offer students the ability to earn certificates or concentrate their studies on an area like business law. Earning certificates and completing a concentration requires additional courses in business law, such as securities regulation, business organizations, and corporate finance.

    Some schools offer joint Juris Doctor and Master of Law programs in business law. These programs usually require an extra semester of study and award students both degrees upon graduation.

    Success Tips:

    Complete elective classes in business law. Even if students decide not to complete a certificate or concentration or earn an extra degree in business law, completing elective classes in business law may increase their knowledge of the field. Elective business law classes may cover topics like commercial paper, insurance law, deals, mergers and acquisitions, contract drafting, and partnerships.

    You might also volunteer at a business law clinic. Most law schools offer students the ability to participate in clinics during their studies. In these clinics, some of which may focus on business law, students are provided with hands-on experience managing business law disputes.

    Step 4: Pass the Bar Exam

    Every state requires lawyers to pass an exam and be admitted to its bar association to practice law. The format of each state’s bar exam differs but may include multiple-choice and essay questions. Some exams are held over multiple days.

    Before sitting for the bar exam, make sure you are fully prepared. Because failing the bar exam prevents an individual from practicing law, preparation is essential. Many companies offer multi-week prep classes designed to assist students in passing the bar exam in the state in which they intend to practice.

    Step 5: Consider Earning a Master of Law

    Lawyers who did not complete a joint Juris Doctor and Master of Law program while attending law school may consider earning a Master of Law in business law after practicing for a few years. Master of Law programs are designed for licensed attorneys and provide in-depth instruction in the field. Classes may cover topics like business tax problems, copyright law, business torts, and secured transactions. Advanced education can make an individual more marketable and increase job prospects.

    False Imprisonment

    False imprisonment is the unlawful restraint of a person against her will by someone without legal authority or justification. For example, an armed bank robber yells at the customers to get down on the floor, threatening to shoot them if they try to leave. Since they know they might be killed if they try to leave, they are being held against their will. The captive bank customers may be able to claim damages, and the bank robber may be charged with the crime of false imprisonment. Even the police may be charged with false imprisonment if they exceed their authority (such as detaining someone without justification).

    In fact, any person who intentionally restricts another’s freedom of movement without their consent (and without legal justification) may be liable for false imprisonment, which is both a crime and a civil wrong. It can occur in a room, on the streets, or even in a moving vehicle—just as long as the subject is unable to move freely, against his or her will.

    Similarly, false arrest is when someone arrests another individual without the legal authority to do so, which becomes false imprisonment the moment he or she is taken into custody.

    Elements of a False Imprisonment Claim

    All states have false imprisonment laws to protect against unlawful confinement. To prove a false imprisonment claim in a civil lawsuit, the following elements must be present:

    • There must have been a willful detention;
    • The detention must have been without consent; and
    • The detention was unlawful.

    False imprisonment can come in many forms, including any threat or use of authority that confines you against your will. While physical force is often used, it is not required. Moreover, the restraint of a person may be imposed by physical barriers (such as being locked in a car) or by unreasonable duress (such as holding someone within the bounds of a fixed area over a long period of time).

    A person claiming false imprisonment must have reasonably believed that he was being confined. A court will determine whether his belief was reasonable by determining what would a reasonable prudent person under similar circumstances would do or believe.

    In addition, the person doing the confinement must have intended to confine, and not have the privilege to do so, such as shopkeepers who are permissibly investigating shoplifting at a store or civilians who have witnessed a felony.

    Examples of false imprisonment may include:

    • A person locking another person in a room without their permission
    • A person holding something of value to another person with the intent to make the person stay in a certain place, and without the consent of the person whose valuables are being held
    • A person grabbing onto another person without their consent, and holding them so that they cannot leave
    • A security guard or store owner who detains you for an unreasonable amount of time based on the way you look or dress
    • An employer who detains someone for questioning for an unreasonable amount of time for suspected theft
    • Nursing home staff who medicates a patient without their consent under physical or emotional threat

    Conversely, things that do not constitute false imprisonment may include:

    • A claim that you were falsely imprisoned simply because you were found innocent of a crime
    • A person who grabs your arm but you know you can free yourself from his grip without fear of retaliation
    • A storekeeper who detains you for a reasonable amount of time for questioning based on probably cause, such as if she saw you take a concealed item out of the store without paying for it
    • A person who closes the front door and asks you not to leave, but you know you can leave through an open side door

    Defenses to False Imprisonment Claims

    Defenses to false imprisonment claims often turn on whether the person claiming the imprisonment gave consent either actual or implied or whether the person who confined another had reasonable grounds to justify the imprisonment. Below are common defenses to a false imprisonment claim:

    A person who consents to confinement, without duress, coercion, or fraud, may not later claim false imprisonment. Therefore, voluntary consent to confinement is often a defense to false imprisonment.

    In all states, police officers have the right to detain someone they have probable cause to believe has engaged in wrongdoing, or when they believe a crime has been committed.

    Many states have laws protecting merchants from false imprisonment claims. These laws typically allow merchants to detain retail patrons for a brief period of time when they have reasonable grounds to believe that the person has committed retail theft. In many instances, a shopkeeper is limited to detaining a person to request or verify ID, make a reasonable inquiry into whether the person has purchased the merchandise, and/or to hold the person in custody until a peace officer arrives.

    In determining liability, a court till look at whether the store’s actions under the circumstances were reasonable. A guilty shoplifter can still sue for false imprisonment then if the detention was unreasonable.

    In some instances, a person who is not a law enforcement official can make a citizen’s arrest by calling for a peace officer when a crime is committed or attempted in their presence, although this defense is not meant to give citizens the right to take the place of law enforcement.

    Seriously, though, agh, it s so sad to see him in this situation at all, and seeing somebody with his kind of unique memory struggling to remember things makes it all the more upsetting. I like the toughness of this lawyer, though, and look forward to seeing how she ll work to help Reid out. I think this episode could make me even more nervous than last week s did!

    I thought both actors did a good job with the interrogation scene. I like that Reid appears to have a strong lawyer and look forward to seeing her handle his case.

    IS Reid going off the show?

    Erica Messer said something in an interview about wanting it to seem realistic. Last night, there was a line about how pleading guilty would end Reid s career. Um, IRL, wouldn t an agent s career likely already be over just on the accusation and with all of the evidence? Even if he or she was later proven innocent. They would likely be asked to resign. They would always be a liability in any court case. All a defense attorney would have to do is bring it up in court that the agent was once accused of murder. It would be enough for reasonable doubt, so any criminal could potentially get off charges in any case in which said agent was involved. so how are they going to justify him still staying with the team and make it realistic? Just having him as a consultant only could still possibly bring up the same issues. They should have used his mom as the potential killer, not Spencer. It would still give MGG the emotional acting challenge without the whole potential liability to court cases against unsubs.

    You bring up some interesting points. Perhaps Reid will be asked to resign in the season finale but there will be a way to keep him around come season 13. I m not sure how that would work, but I certainly want Reid to stay! That said, while this is all a bit confusing, I m enjoying the current story and am happy to see more of Spencer! I do wish Morgan could be here to help in all of this though.

    A statute of limitations sets the period of time someone has to take some kind of legal action. Statutes of limitation, for example, set deadlines for suing. When a plaintiff misses the cutoff, the defendant can use the statute of limitations as a defense against the suit. If the defendant establishes that the statute of limitations applies and has indeed run, the court will normally dismiss the case.

    Time Limits on Claims

    For statute-of-limitations purposes, the clock normally starts to tick when the claim arises. Courts sometimes refer to this starting point as the accrual of the cause of action ; it s the moment at which the plaintiff has a basis to sue. (Certain events and circumstances can delay or toll statutes of limitations, essentially lengthening the time period for bringing a claim.)

    Assume one person wants to sue another for assault and battery. Assume also that the statute of limitations for assault and battery is two years. In a typical case, the plaintiff would have two years from the date of being hit by the defendant to file suit.

    Statutes of limitations can vary from state to state, and from state court to federal court. They also differ depending on the kind of action involved.

    Below you ll find statutes of limitations for several claims in Tennessee. You can see the statutes to learn more and to look for changes to them. (Be aware that court rulings determine the way statutes are interpreted; they can even make statutes or parts of them unenforceable.)

    Keep in mind that the following is a partial list with broad overviews; you should look at the actual law for nuances and exceptions. For example, whether because the statute says so or a court has decided as much, a limitations period can start to run from the point that the plaintiff knew or should have known of an injury rather than the date of the injury itself. A statute might even provide, for instance, that you have two years to bring an action from the date you knew or should have known that you suffered some kind of harm, but in no event do you have more than six years from the date of the event in question. Examining the law would provide you with that level of detail.

    Also, even if one of the causes of action below seems to apply, you might have grounds for a different or an additional claim with its own statute of limitations. Not only that, but a more specific statute of limitations than what s below could control your case perhaps a statute of limitations for mortgage foreclosure rather than one for contracts.

    Make sure to consult a lawyer for a better understanding of all time limits that apply to your situation and any possibilities for overcoming them. Rules might differ when the action is against the government. Or you might have to file a particular kind of claim before being able to sue. In short, the law in this area is complicated.

While in the majority of cases, it was an occupational hazard that the men were exposed to, women and children that were family members were easily exposed by the dust that the men had on their clothes and would get into the household air and floors for the other family members to inhale and increase their exposure. The American Lung Association has identified Mesothelioma, asbestosis, and lung cancer as common types of lung disease and cancer caused by asbestos exposure.

    OSHA (The U.S. Department of Labor’s Occupational Safety & Health Administration) has outlined guidelines for dealing with the potential risk of exposure in the workplace today.     Theme Park Litigation

    As residents of Southern California, our firm realizes that we are privileged to have some of the nation’s best theme parks at our disposal. Just like most people we have childhood memories of not being able to fall asleep the night before a family trip to the local theme park. It is no wonder that people flock to such parks in the pursuit of entertainment and the addicting adrenaline rush that makes adults act as if they were young again. However, does attendance at such parks or the willingness to ride a roller coaster give permission to such parks to inadequately maintain such rides?

    Aitken * Aitken * Cohn has been involved in litigating two of the largest theme park cases that received nation-wide media coverage. In 1998 our firm represented a family in a wrongful death matter of a 34-year-old Microsoft Computer Programmer who was struck by a metal cleat which detached from a signature Disney ride “the Sailing Ship Columbia” in front of his wife and grandchildren. His wife was also struck by the metal cleat and she suffered severe facial injuries.

    Aggressive investigation determined that the Columbia incident was caused by a variety of Disney failures. First, the Columbia Incident was caused by Disney’s failure to train its employees on the proper docking of the Columbia. Second, the Columbia was not properly maintained prior to the incident. Investigation established that the subject cleat was not properly secured and that “wood rot” also contributed to the incident. Third, expert witnesses contended that Disney used an improper rope to dock the Columbia. Authentic “hemp” rope was originally used; but hemp was replaced by nylon rope for economic reasons.     The “Columbia” incident sparked a national debate over the safety of our theme parks. Particularly, in California, legislation was enacted specifically designed to ensure independent inspection of theme parks, such as Disneyland. That legislation provided mandatory inspection by the Occupational Safety and Health Administration (“OSHA”). The Columbia incident also changed police response to accidents in Disneyland following the 4 ½ hour delay by the Anaheim Police to investigate the Columbia tragedy. The Anaheim Police Department has since placed a full time officer at Disneyland.

    The new state law that resulted from the Columbia is now getting its first major test as workplace safety officials investigate two recent accidents. In one accident, two workers (represented by the Aitken * Aitken * Cohn) were seriously injured at Disney California Adventure while working on the Grand Californian Hotel.     Recently our firm represented a family in a wrongful death matter of a 22-year old graphic designer who was killed on Big Thunder Mountain Railroad roller coaster at Disneyland, California. The young man was seated in the first car just behind the faux locomotive. Investigations conducted by OSHA and our experts revealed that the train derailed due to faulty maintenance. As the locomotive entered the last turn before the tunnel, the train’s wheels began falling apart. The derailed wheels slammed into the brakes attached to the floor. Upon impact the rear of the locomotive shot up and the nose down allowing the passenger case to be crushed under the rear of the locomotive.

    How Chapter 7 Bankruptcy Works

    There are generally 2 types of bankruptcy for the average debtor. a Chapter 7 bankruptcy and Chapter 13 bankruptcy. To determine if you qualify for a Chapter 7 bankruptcy, the court uses 2 tests for eligibility, the Means Test (or your income relative to the average American median income) and the Totality of the Circumstances Test (or look at the total circumstances to determine your monthly debt to income). The courts also consider a 3rd test called the Special Circumstances Test which looks at circumstances of a situation (like major medical, health, or other factors).

    Discharge

    When a person receives a Bankruptcy Discharge. the discharge allows the debtor to discharge all underlying contractual obligations on unsecured debts. A Chapter 7 bankruptcy is known as a fresh start because it allows debtor (or the person filing the bankruptcy) the opportunity of a fresh start from the unsecured creditors of credit cards, medical bills, and other types of debt. A Chapter 7 bankruptcy allows the debtor to get rid of or discharge most unsecured debts. A Bankruptcy Discharge means that the estate has successfully discharged all unsecured debts that are owed.

    Federal Bankruptcy Stay Order

    When a person files a Chapter 7 Bankruptcy Petition. they are protected under federal law by a Federal Bankruptcy Stay Order. which stops most lawsuits. If there are pending garnishments or repossessions, the filing of the bankruptcy may stop the collection efforts (except for child support).

    Bankruptcy Trustee

    A 341 Meeting of Creditors is conducted to evaluate the debtor’s situation. The Bankruptcy Trustee represents the various creditors of the debtor, and Trustee’s Duty is to evaluate all the assets and liabilities of the debtor. A Trustee has the power to Avoid Liens and recover assets on behalf of the bankruptcy estate. The debtor is entitled to a certain amount of protection through exemptions provided by state and federal law. These exemptions allow the debtor to protect some equity in cars, bank accounts, houses, and tax refunds. The Bankruptcy Trustee can sell property if there is equity in the property, and they can Distribute the Proceeds to the various creditors according to priority of the claim.

    Non-Dischargeable Debts

    Generally, a federal stay order applies to all unsecured debts. However, some debts are not eliminated in a Chapter 7 bankruptcy. The most common non-dischargeable debts are taxes. student loans. child support. and government loans. Any debt created by false pretenses, a false representation, or actual fraud is also not dischargeable. Also, any personal injury caused by a motor vehicle driven by debtor while intoxicated may not be dischargeable. Generally, a creditor needs to bring a non-dischargeable adversary action to assert a debt survives bankruptcy discharge. The exception to bringing an adversary action is child support, taxes, and most student loans.

    Repossession

    With automobiles, a Chapter 7 bankruptcy filing may stall out repossession efforts. There is usually a 45 day period after filing where the creditor cannot repossess the car. During that time period, a debtor may be able to work out payment arrangements with a car company. Only a Ch. 13 bankruptcy filing can help catch up on car and house payments. In addition, sometimes a Ch. 13 bankruptcy can “cram down” the amount owed on a car if the car has been owned more than 910 days. A Redemption makes it possible to reduce an existing car loan down to fair market value.

    Utility Shut-Offs

    Some Utility Shut-Offs may be stopped for a limited time after filing for bankruptcy. The Utility company may request an additional deposit within 20 days of the filing of the bankruptcy petition.

    Dismissal

    If a Ch. 7 bankruptcy case fails, it is dismissed. Generally, a dismissal is a bad thing. There are various effects of dismissal. One of the major effects is that creditors can go after the debtor and try to collect again against them. The creditor can garnish wages, go after bank accounts, file judgment liens, or suspend driver’s licenses in the effort to collect on the debt. Sometimes a bankruptcy case can be converted to another type of bankruptcy.

    The four thugs accused of savagely killing a young Hoboken lawyer in a New Jersey mall’s parking garage have extensive criminal histories — and one had been released from jail just four days before the slaying.

    Dustin Friedland, 30, and his wife had just finished their holiday shopping when they returned to their silver 2012 Range Rover and were confronted by the four carjackers, cops said.

    Karif Ford, 31, Basim Henry, 32, and Kevin Roberts, 33, all of Newark, and Hanif Thompson, 29, of Irvington, were all busted. Each is being held on $2 million bail.

    The four face a slew of charges in the Dec. 15 killing, including murder, carjacking, conspiracy and weapons possession, authorities said Saturday. Authorities refused to name the triggerman who shot Friedland point-blank in the head.

    All four — who face possible life sentences — have rap sheets stretching back years that include multiple burglary and drug counts.

    Thompson, who has done more than a dozen stints in the Essex County Jail, was released on Dec. 11 after serving time on a burglary charge.

    Roberts has been arrested 13 times on narcotics and weapons offenses.

    Both Ford and Henry were sent to prison in 2003 — Ford for burglary and Henry for bank robbery, records show.

    Henry finished federal prison time eight months ago for a robbery in which he put a gun to the head of a Union Township bank employee.

    Henry was busted for the mall shooting at a hotel in Easton, Pa. by an FBI task force and US marshals. Thompson was captured in Irvington, NJ, and Ford and Roberts were nabbed in Newark.

    A woman who knew Thompson told The Post he was “a hustler” who sold drugs, but doubted he was a murderer.

    Tiwanna Myers, 36, said she often saw Thompson around her Newark neighborhood before he moved out a couple of years ago.

    “I don’t think he was a killer, but he was a hustler,” she said, adding: “I don’t think he’d kill anybody over no car. He hustled in the street — that’s how he made ends meet.”

    A man who answered the door at Roberts’ home in Newark identified himself as the suspect’s brother but refused to give his name.

    When asked if Roberts was innocent, the brother stopped, then said: “I don’t know.”
    It was the “around the clock work” of law enforcement that helped nab the quartet after a weeklong manhunt, said Acting Essex County prosecutor Carolyn Murray.

    Prosecutors said the suspects wanted the victim’s luxury ride.

    “We are very grateful to the Essex County Police and all of the local authorities for pursuing this so vigorously,” the victim’s wife, Jamie Schare Friedland, said in a statement.

    The whereabouts of a San Antonio attorney accused of fabricating court documents and forging judges signatures appear to be a mystery.

    Lawyer Todd Prins failed to appear at a court hearing Monday despite instructions by U.S. Bankruptcy Judge Craig Gargotta that he needed to attend the proceedings.

    Martin Seidler. Prins attorney, said he did not know Prins whereabouts.

    All I can relay to the court was he couldn t make it in time, Seidler told Gargotta. Although Prins skipped the hearing, the FBI and U.S. attorney s office didn t. A federal prosecutor and FBI agent sat in the middle of the court room.

    Two of Prins former clients have sued him in bankruptcy, alleging he made up court documents to conceal the status of a lawsuit he had represented them in.

In the state of Pennsylvania alone, the number of medical malpractice claims tallied up to 25,283 plaintiffs, entailing 15,479 health care providers, during the same timeframe.     Prevalence of Medical Errors in Pennsylvania

    A study published in the September 2013 issue of the Journal of Patient Safety reported the number of deaths attributable to hospital error could be at least 210,000 – and perhaps as high as 440,000. Those figures are extrapolated from case studies and don’t include errors made in non-hospital settings.

    According to the study’s author, a toxicologist for NASA, a number of factors make it difficult to say exactly how many deaths are caused by hospital error. Some medical errors are simply not reported. Another study found that 45 percent of physicians who believed fellow doctors were impaired or incompetent didn’t report their suspicions to anyone.

    Medical errors may be immediately evident, such as a medication overdose that causes cardiac arrest. Symptoms of other medical errors may be delayed, such as a disease caused by contaminated equipment. And in one shocking case reported in the quarterly medical journal Hippokratia. a woman discovered three years after a liver operation that her surgeon had left the forceps in her abdomen.

    Medical mistakes can happen for a number of reasons:

    Communication – When communication breaks down between two doctors treating the same patient, or among hospital staff, people making important decisions for patients may not have all the information they need.

    Record-keeping – Inconsistent, outdated, or inadequate record-keeping can cause doctors to miss important details, like a patient’s medication allergies.

    Procedures – A health care facility may lack adequate procedures for sanitation and patient handling.

    Staff shortages – In understaffed health care facilities, people may try to get more done by cutting corners, or ignoring procedures.

    Lack of sleep – Some doctors and surgeons work incredibly long hours – so much so, that their ability to think clearly and handle medical instruments may be compromised.

    Chemical dependence – Medical professionals encounter a lot of stressful situations that could increase their risk of alcohol and drug dependence. In a 2012 survey of 7,197 surgeons, 15.4 percent who took the Alcohol Use Disorders Identification Test (AUDIT) had scores indicating alcohol abuse or dependence.

    Types of Life Insurance Policies

    There are several different types of life insurance policies to chose from. People typically want life insurance so their loved ones will receive money if they die an untimely death. But life insurance can do more than that; it can also be an effective financial tool.

    There are two primary types of life insurance policies, term life insurance and whole life insurance:

    • Term Life Insurance – Term life insurance refers to a policy where the policy holder makes payments to the life insurance company at regular intervals, either monthly or yearly. The holder makes these payments for a specified period of time, such as 5, 10, or 20 years. If they die during that term, then the life insurance company pays a specified amount of money to whomever has been designated as the beneficiary.
      • If the person does not die during that term, then the life insurance pays nothing. Most insurance companies will allow the holder to renew the policy for another term, but at higher premiums.
    • Whole Life Insurance – Whole life insurance, also known as ordinary, cash value, and universal life insurance, is similar to term life insurance in that the policy holder makes regular payments called premiums. However, they are different in that cash value life insurance spans one’s whole life, whereas term life insurance only covers a specified period of time. Thus, no matter when someone dies, the life insurance company will pay out as long as that person has been paying premiums.
      • A benefit to whole life insurance is that the policy holder will build up cash value. This means that a portion of premiums will be kept in an interest earning account. There are several ways the policy holder can use the cash value of their life insurance:
        • Get a loan – It is possible to borrow money against cash value. This option is better than a conventional loan because the insurance company will not check credit reports and there is no repayment schedule. However, one cannot borrow more than the total cash value.
        • Surrender the cash value – The policy holder can cancel their policy and get cash value in a lump sum. This is often referred to as cashing out.
        • Skip a premium payment – If the holder needs to miss a premium payment, they can use cash value to pay it, thus continuing the life insurance coverage. This can only be done until cash value reaches zero, at which point the life insurance will be canceled if the policy holder do not pay their premium.
      • Disadvantages include higher premiums than term life insurance. Additionally, term life insurance tends to be better for older people since cash values take some time to accumulate.
