    Texas Divorce Mediation FAQs

    What is Divorce Mediation?

    Divorce mediation is a private process in which a neutral third person (a mediator) helps divorcing couples reach a mutually satisfactory settlement of the issues in their case, including child support, custody and visitation, alimony, and property division. A mediator does not act as a judge, arbitrator, or counselor, but assists the spouses in reaching a voluntary agreement.

    How is Mediation Used in Texas Divorce Cases?

    Mediation is one of the most frequently used methods of negotiating a property or custody agreement in Texas divorce cases. An attempt at mediation is required (or strongly recommended) in many Texas counties. Travis County, for example, requires mediation when it s anticipated that a hearing before a judge on a family law dispute will take three hours or more.

    What is the Value of Mediation in Texas Divorce Cases?

    Mediation has many benefits in divorce cases, including:

    • it s less expensive than using a lawyer to take the same case through the courts
    • mediation has a high success rate in resolving divorce issues, especially when both spouse are open to compromise and committed to reaching an agreement
    • mediation is confidential there s no public record of what goes on in your sessions (as opposed to a public courtroom where a record of all proceedings is made)
    • you and your spouse (not a judge) are in control of the decision-making process, and you have more flexibility in arriving at your own solutions
    • mediation can help improve communication and make future interactions with your spouse easier (especially important if you will have an ongoing relationship because you have children together), and
    • you can still ask a lawyer for advice if you wish (eg. you can hire a consulting attorney to answer legal questions you may have during the mediation process and review the proposed divorce settlement agreement to make sure your rights are fully protected).

    How Long will Mediation Take?

    A divorce mediation process can be as long or as short as the spouses determine is necessary to negotiate a full and fair agreement. Mediation could take place in one or two sessions in one week, or many sessions over a period of months, depending on the complexity of the financial and custody issues involved and the willingness of the spouses to negotiate and compromise. Mediation almost always takes less time than going to court and is usually much less expensive than a contested divorce case.

    What s a Typical Mediation Session Like?

    You and your spouse may be in the same room for the entire mediation, or you may meet in separate sessions so that you can give the mediator your opinions and positions in private. After meeting with both of you, the mediator will assess where you and your spouse agree, where you need some work to reach agreement, and how you are going to accomplish this. For example, if you and your spouse are dealing with the question of who stays in the family home, the mediator will help you figure out what information and materials you need to make a decision (such as financial records) and will ask each of you to commit to bringing these to the next session.

    What Happens Once we Reach an Agreement?

    Once you reach an agreement for example, regarding a parenting plan the mediator will reduce it to writing in what s known as a Rule 11 Agreement (this refers to a section of the Texas Rules of Civil Procedure). Once both you and your spouse sign the agreement, it is a binding and irrevocable agreement that gets filed with the court. If you and your spouse have both hired attorneys, they will use your Rule 11 Agreement to compose the more formal, final divorce paperwork that will be presented to the court for signature.

    What if we Can t Reach an Agreement in Mediation?

    If mediation isn’t working, or if you and your spouse have reached agreement on most. but not all issues, you will probably end up in court, where a judge will make the final decisions on any remaining divorce issues.

    Are There Situations When Mediation is not Appropriate?

    If there is a history of domestic violence or substance abuse in your relationship, you may not really be in a position to engage in mediation. For example, if you’re the victim of domestic abuse, your spouse will undoubtedly have the upper hand in mediation, and may even try to intimidate you with the threat of further physical abuse in order to force you to accept an unfair agreement. The agreements made during mediation must be voluntary; if you’re afraid of your spouse, or if your spouse is forcing you to accept unreasonable terms, you will walk away with an unfair agreement.

    How do I Find a Texas Divorce Mediator?

    If the court orders you to go to mediation, you ll probably use court-appointed mediators, and you ll be required to pay a fee. If you want to hire a private mediator, your attorney will have suggestions, or you can get recommendations from others, such as a therapist or a friend who s been through a divorce. You can also check out Texas mediators on www.mediate.com. Make sure that you only work with a mediator who has experience in divorce cases — ideally, one who is an experienced family law attorney.

    Asbestos is not directly dangerous to humans when it is in its chemically bonded form, only when that bond is broken, the fibers then get airborne, and are then inhaled, is it known to be harmful to humans. Whether it’s a one-time only exposure or long term exposure to the inhaling of the fibers; it can take anywhere from 10-50 years to develop asbestos related illnesses after the initial exposure. Some people may never develop these illnesses and it is more common for men than women to develop them. While in the majority of cases, it was an occupational hazard that the men were exposed to, women and children that were family members were easily exposed by the dust that the men had on their clothes and would get into the household air and floors for the other family members to inhale and increase their exposure. The American Lung Association has identified Mesothelioma, asbestosis, and lung cancer as common types of lung disease and cancer caused by asbestos exposure.

    OSHA (The U.S. Department of Labor’s Occupational Safety & Health Administration) has outlined guidelines for dealing with the potential risk of exposure in the workplace today.     The Recording Conservatory is the premier Audio Engineering, Video and Music Production, and Business School.     Beginning Audio Engineering – 8 Months

    The Beginning Audio Engineering Program is approximately 8 months long and is a comprehensive program that is designed to teach you everything you would need to know to function as an audio engineer in a professional recording studio. You will meet one-on-one with different instructors four hours each week to cover course subjects. Additionally you will do two assists a week for the first four weeks with other professional and student engineers in our state of the art facilities. At week five you will start your own projects. You will do as many as six projects in the beginning class alone. Each one of these projects will cover seeking the artists you would like to work with, booking them on the studio calendar, recording, editing, overdubbing, mixing, and mastering. Unlike many other schools where projects are completed in groups, you will own your projects from bringing in the artist to mastering the final mix. By the time you get out of the beginning program you will know how to and will have done the entire recording process as many as six times.

    Recording Arts – 16 Months (Includes BAE)

    The Recording Arts Program is approximately 16 months long and includes the Beginning Audio Engineering Program. The 8 months beyond Beginning Audio Engineering are designed to take you directly on a video and music production career path. Working in the video and music industries is very reputation oriented. Often it is difficult for beginning audio engineers and music producers, even if they are accomplished, to gain a foothold. If they aren’t working then they aren’t gaining a reputation and if they don’t have a reputation as an audio engineer or music producer then they aren’t getting work. The second 8 months are a direct answer to that problem. During the program you will be seeking out what will be potential clients, bringing them into the studio, and doing single full production songs with them. In the Advanced Program you will do as many as 10 music production projects like this (10 single songs with the intent to create a client). Through this process you will be learning how to find and interact with potential clients, how to build client relationships, and a refinement of the music production skills you started in the beginning program. In tandem to your music production projects you will be attending a weekly music business, beat composition, marketing and design, and Pro Tools lesson. The business and marketing lessons will cover everything from designing your own business card and website to understanding QuickBooks, music law, and video and music publishing. The beat composition lessons combine traditional songwriting techniques with the use of the most current beat production software. You will learn how to compose, arrange, and write charts on today’s most powerful and exciting songwriting software. There are very few students that make it all the way through the Recording Arts Program that don’t create at least a client or two. So, if you continue the path we start you on during the program, you will have a solid client base in the coming years.

    Audio and Video Arts – 24 Months (Includes RA)

    The Recording and Video Arts Program is approximately 24 months long and includes the Recording Arts Program. The 8 months beyond The Recording Arts Program are designed to teach you every aspect of music video production and internet media development.     How to apply

    Applying to the Counseling and Development (C D) program is a two-step process. Step one requires an application to the TWU Graduate School, while step two requires an �application process� to the TWU Department of Family Sciences C D program.

    1. APPLY to the TWU Graduate School by going online to www.applytexas.org. Be sure to specify Texas Woman�s University as the target university, the semester and year you wish to begin taking classes, and Counseling and Development (MS) as the major.
    2. WAIT to receive your letter of acceptance or otherwise notified that you have been accepted. Once the application fee and all transcripts are received, it can take 4-6 weeks to process your application and receive your letter via U.S. Mail.
    3. CONTACT the Department of Family Sciences to register to attend the next Interview Day event. Interview Day is the time when the C D faculty evaluate your candidacy as a major in the C D program. It will consist of an opportunity to provide a writing sample, conduct an individual interview with faculty, participate in a mock group counseling session, and allow opportunity to ask questions and network with other applicants.
    4. WAIT for a decision from the C D program concerning your acceptance. Please allow 2-3 weeks to receive a decision after the Interview Day event.
    5. Upon acceptance. ENROLL in classes during early registration to ensure you get what you want. You should plan to take these courses during your first two semesters:

    Arlington is a city in Tarrant County, Texas (USA) within the Dallas–Fort Worth metropolitan area.     Of all the insertables used in role play, the catheters offer a special sort of control game for the BDSM scene. There is no control over the urinary function: if the catheter is left open, the bladder will drain completely into a leg bag (as shown left) or a larger table/bedside drainage bag and continue to drain as more urine is produced by the body.

    Catheters: Brief History

    The earliest precursor to the present day Foley catheter is documented in 3000 B.C. It is believed that Egyptians used metal pipes to perform bladder catheterizations. As early as 400 B.C. hollow reeds and pipes were used in cadavers to study the form and function of cardiac valves.

    In 1844, Claude Bernard inserted a mercury thermometer into the carotid artery of a horse and advanced it through the aortic valve into the left ventricle to measure blood temperature. It is because of his work that the use of catheters became the method of standard for physiologists in the study of cardiovascular blood flow.

    Adolph Fick took another major step in the development of cardiac catheterization in 1870. His famous note on the calculation of blood flow is the basis for today’s cardiac procedures.

    Among the earliest published descriptions of human catheterization were done by Fritz Bleichroeder, E. Unger, and W. Loeb in 1912. They were among the first to insert catheters into the blood vessels without x-ray visualization. Interest in catheterization was also stimulated with the advent of chemotherapy.

    Early chemotherapy required the injection of drugs directly into the central circulation. Bleichroeder inserted catheters into dog arteries and assessed the effects after leaving them in place for several hours. He reported no complications or clots.

    The Foley Catheter came into existence in the 1930s. Frederick E. B. Foley began to experiment with different catheters of the time. He realized that urinary catheters would easily slip out of the bladder because there was no way to hold them in place.

    Foley experimented with different methods of securing the catheter until he came up with the idea of attaching a balloon-like device to the end of the catheter. The device would then be able to be placed and then inflated from the outside. By 1934, Foley catheters were on the market. Other than in material, the Foley catheter remains relatively unchanged in design today!

    Male External Catheters or “Texas Catheters”

    Male external catheters have traditionally been used for the management of urinary incontinence due to surgery, injury and disease. These “condom type” devices are placed over the penis and attached to a collection device, usually a leg bag which is worn under the clothes for mobility or a bedside drainage bag for prolonged bed stays.

    The nonsensitizing adhesive provides a reliable bond to the skin for extra confidence and maximum wear time. A kink-proof funnel helps ensure uninterrupted urine flow.

    They are clear which allows easy inspection of skin and attachment area and made of either latex or silicone.

    Our wide band Texas catheter has the adhesive built into almost the entire sheath wall. It has 70% more adhesive area than is found in other self-adhering styles, which helps prevent urine migration up the penis shaft, which results in premature removal, and it helps prevent urine build-up around the head of the penis, which results in catheter blow-off!

    There are basically two levels of gun laws in Texas: the state and federal law. Although Texas resident must comply with the federal laws regarding handgun and rifle possession, there are state laws which apply only to residents while they are in the state. Every gun owner should familiarize themselves with these laws to insure safe ownership. In Texas, it falls to the Texas Department of Public Safety to provide all the pertinent gun law details as well as processing the applications for the conceal and carry registration. If you live in Texas and plan to purchase or already own a gun, you should definitely bookmark TDPS website.

    Texas Gun Permits
    In Texas, as with most other states, there is a distinction made between handguns versus shotguns and rifles. In Texas, you do not need a permit to purchase a gun or rifle. You also do not need to register those weapons or have a license to be an owner of a handgun or rifle. There is a distinction made with regard to the right to carry a gun. Simply put you can’t carry a rifle but you can carry a concealed handgun.

    However, if you are on your own property, are hunting or involved in a shooting activity such as at an exhibition or gun range you are permitted to openly carry your handgun and/or rifle and shotgun.

    All of this boils down to the simple conclusion that if you are a Texas resident, above the age of 21 without any criminal restrictions you can buy and own a gun. This also includes any ammunition, firearm accessories or reloading components.

    Texas Gun Restrictions
    Just because there aren’t any strident permit restrictions to owning or buying a gun doesn’t mean there aren’t some general restrictions that you need to follow as a Texas resident. First of all, you are not allowed to lend, buy, or give a gun, rifle or shotgun to anyone under the age of 18 without the written consent of their parent or guardian. You might have good intentions to want to teach a favorite nephew, niece, cousin or even younger brother or sister all about gun safety and handling but you need to get permission first. Even if it’s your own parents, get it in writing.

    You also can’t give a gun to anyone who you know is going to commit an unlawful act or who might be intoxicated. That’s obviously common sense. However, if you do cross that line you will and can be held responsible for that person’s actions. If you have been convicted of a felony crime or Class A misdemeanor you will not be allowed to purchase or own a gun of any kind.

    Texas Concealed Carry Gun Laws
    If you are a qualified resident of Texas you are permitted to apply for a conceal carry gun permit. This pertains only to handguns. The applications can be obtained by the gun store you bought the gun from or directly through the Texas Department of Public Safety. As the name implies, concealed carry means that your handgun needs to be concealed on your person. Although it might seem appropriate in Texas to have a holster and six shooter, that is against the law unless you are on your own property or involved with a sport activity.

    If you are driving and have a concealed carry permit your handgun still needs to be concealed. It can be loaded and within reach but still has to be concealed. You can’t have it sitting in your lap or on the seat beside you. Even with a concealed handgun license you’re restricted from carrying that firearm at the following locations:

    A bar, any court, any school or college, an amusement park, nursing home, hospital, place of worship, race track, polling place on a day of an election, airport, and prison. And if you have a concealed carry permit and become intoxicated, you are breaking the law.

    In order to obtain the concealed carry permit along with the proper application you will need to present two color passport photos, fingerprints, proof of residency and age as well as certification from a licensed handgun instructor.

    Internet Service Termination

    It is with a heavy heart we have to inform you that after 25+ years in the Internet business we will be closing our doors for this service on 11/27/2013.

    We wish to thank all our customers for their trust in our company over the years to provide internet services, it truly has been a blessing to serve each and every one of you over the years but with recent events it is no longer feasible to continue providing such services. Internet customers will have till 11/22/2013 to find new service providers, after stated date all internet services shall be terminated with Internet Services of Texas.

    We will continue to provide email service to everyone who is subscribed to our email service; we will also provide Business Web Hosting and Web Back Up Access. However we will no longer provide Dial Up, ISDN, DSL or Wireless services. We do understand what an inconvenience this may be, if you have any questions please check our Help Desk section for the answers before calling.

    Fire Damage

    We had fire on Monday, August 19th.

    The fire has destroyed and rendered our building unusable for business operation.

    We have temporarily relocated to three (3) building down the road.

    Our new address is:

    ClearWire Service Suspended

    We are no longer selling ClearWire service. However we will still take payments for existing ClearWire customers.

    Since the Sprint has purchased ClearWire, all ClearWire products has been suspended and no longer available for sale.

    MultiByte Systems still has wireless service at limited areas. Our Dialup Internet and DSL service is not interrupted.

    Emergency File System Check

    On Saturday, we had to perform an emergency server maintenance, and had to bring the server down.

    The maintenance included file system scan, which cannot be interrupted once started.

    This maintenance was required in order to prevent data loss.

    The scan was completed on Monday morning, and all operation has returned normal.

    This is the first maintainence we’ve done in three years of continuous server uptime.

    Thank you for your understanding and appolgize for the down time.

    Access Old Emails

    For all those that used our webmail for your email solution, your old emails from the previous email server can now be accessed at http://oldmail.isot.com. You can also point your mouse to Check Emails then click on Check Old Emails from the pull down menu.

    Please note, all new emails received goes to the new server. New emails will not be received at this old email server. Use the old email server for checking your old emails and/or forward to your new mail server.

    Welcome to the Texas Board of Nursing Website

    We welcome you to the Texas Board of Nursing (BON or Board) website. The BON has been serving the public for more than 100 years since its establishment in 1909 by the Legislature to regulate the safe practice of nursing in Texas. The Board: protects the public from unsafe nursing practice, provides approval for more than 200 nursing education programs, issues licenses to more than 27,000 nurses per year by examination to new graduates and by endorsement to licensees from other states seeking a Texas license, as well as providing nursing practice and education guidance to more than 350,000 currently licensed nurses practicing in the State of Texas. We welcome your feedback as we fulfill our mission to protect and promote the welfare of the people of Texas by ensuring that each person holding a license as a nurse in the State of Texas is competent to practice safely.

    BON Responsibilities and Services

    Licensing: The BON issues licenses to graduates of approved nursing education programs seeking licensure by exam and to nurses licensed in other states seeking Texas licensure by endorsement. All nurses are required to renew their licenses on a biennial basis with evidence of required continuing nursing education. The BON licenses qualified registered nurses to enter practice as advanced practice registered nurses (APRNs), including nurse anesthetists, nurse practitioners, clinical nurse specialists, and nurse midwives.

    School Approval: The Texas Board of Nursing (BON) approves schools of nursing which prepare nurses for initial entry into nursing practice.

    Enforcement: The BON enforces the Nursing Practice Act and Rules and Regulations by setting minimum standards for nursing practice and nursing education, conducting investigations of complaints against nurses, and adjudicating complaints.

    Information: The BON provides a variety of information to customers including verbal, written and electronic information. The BON’s website contains information including the Nursing Practice Act. BON Rules and Guidelines. BON Position Statements. the agency’s physical location. disciplinary, and licensure information. Publications and the Texas Board of Nursing Bulletin (Newsletters) of the BON are available upon request for a minimal fee.

    About the El Paso Campus Center

    Park s campus center in El Paso, TX offers face-to-face classes that are available days, evenings and weekends. Courses can be completed in 8-week sessions rather than a traditional 16-week semester and are taught by faculty committed to the success of each student. Sessions start five times a year, giving you multiple entry points two in the fall, two in the spring, and one in summer.

    Park University has been approved by the Texas Higher Education Coordinating Board and the Texas Workforce Commission for the new location in El Paso.

    The UTEP Accelerated MBA (AMBA) is a fast-track, cohort style MBA option that combines quality, convenience, and affordability for the region s working professionals. Through the AMBA, students can complete their MBA degree in just two years by attending class twice a week on evenings and Saturdays. Students advance through the 48 hour curriculum in six week lock-step modules with a cohort of their peers.     For Executives

    The UTEP Executive MBA (EMBA) is an 18-month cohort format that serves business leaders with at least 5 years of managerial experience who seek to enhance their effectiveness, expand their skillset, and grow their network. EMBA courses are offered every other week (twice monthly) on Friday and Saturday with two courses being offered every 10 weeks. Classes are held from 8:00am to 5:00pm.
