Shipping Times

Most orders are processed and shipped within 1 to 2 business days after your order is submitted, not including custom orders. Jim Carrey Facing Trial in Civil Suit over Girlfriend s Death #jim

Jim Carrey is set to face trial in a civil suit over the death of his girlfriend Cathriona White after a judge refused to dismiss two wrongful death lawsuits filed against the actor.

According to court documents obtained by PEOPLE, a 20-day jury trial date has been set for April 26, 2018. A mediation status conference is also scheduled for Sept. 21, 2017.

White s mother, Brigid Sweetman. is seeking damages from Carrey in a wrongful death and violation of the drug dealer liability act lawsuit, according to court documents previously obtained by PEOPLE. White’s estranged husband Mark Burton also sued the actor .

Sweetman and Burton separately claim that Carrey obtained the drugs that killed White under the false name “Arthur King” and provided them to her, despite knowing she was prone to depression and had previously attempted suicide. Furthermore, Sweetman alleges that Carrey gave White “three STDs without warning her.”

Carrey s attorney Raymond P. Boucher tells PEOPLE in a statement, We look forward to receiving the Court’s ruling regarding the claims in Mr. Burton and Ms. Sweetman’s complaints. Once we receive the order and the plaintiffs file an amended complaint with several inappropriate allegations stricken out, as the Court has asked the plaintiffs to do, we will begin preparing for trial.

He adds, We appreciate Judge Hill’s setting the cases for trial within the year. Mr. Carrey is looking forward to putting these unfounded claims behind him, moving forward towards closure, and allowing Ms. White to rest in peace with dignity.

In the court documents filed earlier this week, the plaintiffs agreed to strike some argumentative adjectives and allegations from the complaint and parties will meet ahead of the trial to go over exactly what will be removed.

Carrey has previously spoken out about the pending lawsuits, calling them a shakedown.

What a terrible shame. It would be easy for me to get in a back room with this man’s lawyer and make this go away, but there are some moments in life when you have to stand up and defend your honor against the evil in this world,” Carrey, 54, said in a statement .

Synovial Fluid Analysis

Synovial fluid analysis is a group of tests that examine joint (synovial) fluid. The tests help diagnose and treat joint-related problems.

How the test is performed

A sample of synovial fluid is needed for this test. Synovial fluid is normally a thick, straw-colored liquid found in small amounts in joints, bursae, and tendon sheaths.

After the area is cleaned, the health care provider will insert a sterile needle through the skin and into the joint space. Once in the joint, fluid is drawn through the needle into a sterile syringe.

The fluid sample is sent to the laboratory. The laboratory technician will check the sample’s color and clarity, and then place it under a microscope to check it for red and white blood cells, crystals (in the case of gout), and bacteria. In addition, there may be a chemical analysis, and if infection is a concern, a sample will be cultured to see if any bacteria grow.

How to prepare for the test

Normally, no special preparation is necessary, but contact your health care provider before the test to make sure. Tell your doctor if you are taking blood thinners, as they can affect test results.

How the test will feel

Occasionally, the health care provider will first inject local anesthesia with a small needle, which will sting. The aspiration is done with a larger needle and may also cause some pain. The procedure usually lasts less than one minute.

Why the test is performed

The test can help diagnose the cause of pain or swelling in joints. Removing the fluid can also help relieve joint pain.

This test may be used to diagnose:

  • Gout
  • Infection
  • Other inflammatory joint conditions
  • Joint injury
  • Osteoarthritis

What abnormal results mean

Abnormal joint fluid may look cloudy or abnormally thick.

Blood in the joint fluid may be a sign of injury inside the joint or a body-wide bleeding problem. An excess amount of normal synovial fluid can also be a sign of osteoarthritis.

What the risks are

  • Infection of the joint — unusual but more common with repeated aspirations
  • Bleeding into the joint space

Special considerations

Ice or cold packs may be applied to the joint for 24 to 36 hours after the test to reduce the swelling and joint pain. Depending on the exact problem, you can probably resume your normal activities after the procedure. Talk to your health care provider to determine what activity is most appropriate for you.

Will new accounting rule slow adoption of cloud computing?

The Financial Accounting Standards Board (FASB) changed a rule in December that will make it harder to capitalize the cost of cloud set-up and implementation expenses, a change that may encourage some enterprises to opt instead for traditional on-premise software.

The FASB Accounting Standards Update to “Intangibles – Goodwill and Other – Internal-use Software (Subtopic 350-40)” addresses “Customer’s accounting for fees paid in a cloud computing arrangement .” And while the update didn’t set out to address how to account for cloud migration costs, the new rules, combined with the FASB’s decision “not to provide additional guidance on the accounting for upfront costs,” will mean enterprise shops can no longer depreciate some fees involved in a cloud migration.

Hugo Vasquez, Deputy CIO and VP of Technology and Services for AES, a Fortune 200 global power company, said prior to the change his company was able to capitalize the cost of a cloud migration project and write off that investment over three years. “Now with the new rules, the project itself cannot be capitalized,” Vasquez says.

How big a deal is that? Vasquez says AES last year migrated to Workday’s cloud-based human resources tool. “We were able to capitalize around $4.46 million to implement the project, which went live at the beginning of this month. Our integrator was Deloitte, and we capitalized those costs and the labor of our own people, so we had an incentive to move forward with a cloud solution. But today I couldn’t capitalize that $4.46 million. And that change is resulting in a reduction in projects in our company to move to a cloud computing model.”

Google, one of many companies that commented on the suggested change before it went into effect Dec. 15, agreed that the shift will dampen interest in cloud computing services. In a comment letter to the FASB submitted by Google, Director of Finance Amie Thuener wrote. “We believe that the Proposed Standard could result in a disincentive to purchase hosted cloud computing arrangements if companies interpret the wording … to mean that implementation costs should be expensed as incurred” (versus capitalized and depreciated).

A host of other large companies, from Visa to Salesforce to Groupon, also weighed in on different aspects of the rule change, collectively suggesting, at the least, that more work needs to be done on this specific issue, say nothing of the larger question about how to account for cloud services going forward.

The intent of the change

The FASB Accounting Standards Update in question set out to clarify the rules because “existing GAAP (generally accepted accounting principals) does not include explicit guidance about a customer’s accounting fees paid in a cloud computing arrangement.” (FASB sets the accounting rules for public companies that the Securities and Exchange Committee enforces.)

In essence the Update concludes that, if a cloud computing arrangement includes a software license, then the customer should “account for the software license element of the arrangement consistent with the acquisition of other software licenses.” Regarding the latter, a company with, say, a $30 million license for an on-premise Oracle product, may capitalize that as an asset and depreciate $10 million per year over three years, recognizing that as an expense on their income statement.

The Update continues: “If a cloud computing arrangement does not include a software license, the customer should account for the arrangement as a service contract.”

One of the perceived advantages of cloud computing is the ability to shift from capital-intensive infrastructure/software investments to a service subscription model paid out of the operating budget, so in and of itself this guidance isn’t too surprising. But the Update goes on to say:

“Some stakeholders wanted the scope of this Update to be expanded to address a customer’s accounting for implementation, set up, and other upfront costs that often are incurred by customers entering into cloud computing arrangements. The activities that entities perform in conjunction with entering into a cloud computing arrangement include training, creating or installing an interface, reconfiguring existing systems, and capturing and reformatting data. The board observed that to the extent a cloud computing arrangement transfers a software license, Subtopic 350-40 provides guidance on how to account for costs such as those resulting from training, data capture, and conversion activities.

“In deciding not to provide additional guidance on the accounting for upfront costs incurred by customers entering into cloud computing arrangements that do not transfer a software license to a customer, the Board noted that initial costs incurred in service arrangements are not unique to cloud computing arrangements. Consequently, the scope of that issue is much broader than the scope of this Update. The Board decided that the scope of this Update should not be expanded to address the range of implementation and setup costs incurred by a customer in a cloud computing arrangement.”

There is, however, disagreement in the comment letters about whether a license is the proper litmus test for cloud service accounting. In HP’s comment letter, Senior Vice President, Controller and Principal Accounting Officer Jeff Ricci writes. “as a vendor, HP generally believes its customer is paying for a hosted service, not the acquisition of software or a software license.”

And if no license is involved, the new rules mean companies can no longer capitalize upfront cloud project costs.

Google urges the FASB to delve deeper on this core issue: “We encourage the FASB to consider issuing explicit guidance with respect to the accounting treatment of implementation costs, as these costs can be significant,” Thuener wrote. “We believe capitalizing the software implementation costs and amortizing the corresponding asset over its useful life better reflects the economics of the transaction as expenses are recorded in a manner that reflects the consumption of the economic benefit from the software implementation costs, and therefore is more helpful to readers of financial statements in the analysis of assets and expenses.”

Even companies that agree with using the license model to figure out how to account for cloud services want the FASB to clarify its position on upfront costs given that the “costs can be substantial.” James Hoffmesiter, Corporate Controller for Visa, writes. “While we are supportive of the FASB’s proposal for how to evaluate the arrangement to determine if it is a software license or a service contract, we respectfully request that the FASB consider expanding the proposed standard to include guidance on the accounting for one-time set-up fees incurred by a customer under a cloud computing arrangement.”

Visa goes on to add another wrinkle to the upfront cost discussion. Instead of capitalizing those costs, Visa argues that the “set-up/integration costs should be considered part of the total service cost and recognized over the term of the service agreement,” because the set-up costs “provide a future benefit to the customer in the form of continuous connectivity to the service provider.”

Bigger question going forward

The FASB more or less admitted there is more work to be done when it determined the “scope of this Update should not be expanded to address the range of implementation and setup costs incurred by a customer,” but some of the companies that commented on the update are pushing for a more fundamental review of cloud computing accounting, and more specifically, the role of licenses in that accounting.

Joseph Allanson, Chief Accounting Officer at Salesforce.com, wrote. “We do not agree with the Board’s proposal that a cloud computing arrangement should be accounted for as a service contract if the arrangement does not include a software license. We believe that the delivery mechanism, or the customer’s ability to take possession of the software, should not determine whether a software element is present in a cloud computing arrangement as the functionality of the underlying software is the same regardless of whether the software is delivered via the cloud or on-premise software license. We encourage the board to develop an accounting framework that is based on the economics rather than the form of the software arrangements.”

Groupon’s Chief Accounting Officer Brian Stevens also called for a broader review. “We believe that accounting guidance resulting in a more consistent presentation of software costs, regardless of whether the purchaser elects to maintain the underlying software on its own servers in an on-premise arrangement or contracts to have it maintained on a third party’s servers in a cloud computing arrangement, would reduce complexity for users of financial statements by increasing comparability between economically similar transactions.”

And in a comment letter filed with the FASB, Jay Buth, Vice President, Controller and Chief Accounting Officer with Northeast Utilities System, argues that “both [software] licenses and cloud rights represent intangible assets, and we believe that … these two economically similar types of arrangements should be given similar accounting treatment. We do not believe an entity’s lack of ownership, title or license to software should preclude capitalization.”

Vasquez of AES hopes the FASB reviews the decision soon because it is “affecting our costs and our projects, which is affecting our people, our morale.”

Canadian Prime Minister Justin Trudeau arrived at the White House Monday, becoming the third world leader to meet with President Donald Trump face to face.

The two leaders couldn’t be more different.

“Because as we know, relationships between neighbors are pretty complex, and we won’t always agree on everything. But because of our deep abiding respect for one another, we’re able to successfully navigate those complexities and still remain the closest of allies and friends,” Trudeau said today at the White House during a joint press conference with President Trump.

Trump added, “We are going to have a great relationship with Canada. Maybe as good or better, hopefully, than ever before.”

Trudeau, 45, is the son of former Canadian Prime Minister Pierre Trudeau. He began his career as a school teacher and advocate for youth and environmental issues before entering politics. Trump made his fortune as a real estate and media mogul.

As Trump received harsh criticism from U.S. allies for his heated and often divisive campaign rhetoric, Trudeau was coined the anti-Trump in several publications and on social media. While on the campaign trial, Trump called for a ban on Muslims entering the U.S. Days later, Trudeau personally greeted dozens of Syrian immigrants in the Toronto International Airport.

“I don’t think it comes as a surprise to anyone that I stand firmly against the politics of division, the politics of fear, the politics of intolerance or hateful rhetoric,” Trudeau said in a town hall in December 2015 when asked about Trump’s campaign rhetoric. “We need to remain focused on keeping our communities safe, keeping our communities united, instead of trying to build walls and scapegoat communities.”

The two leaders’ differences set the stage for what could be a tense discussion over how to handle the Syrian refugee crisis and defense cooperation in the Middle East.

While president, Trump is battling a court ruling that stops his executive order banning most immigration from seven majority-Muslim countries. After issuing the order, Trudeau, without mentioning Trump’s action directly, tweeted a pointed rebuke.

“To those fleeing persecution, terror & war, Canadians will welcome you, regardless of your faith. Diversity is our strength #WelcomeToCanada,” the tweet read.

President Trump has said he wants to bring to the U.S. a total of 50,000 refugees worldwide in 2017, down from 85,000 in Obama’s final year in office. The Canadian government reports that Canada has taken in over 40,000 Syrian refugees since November 4, 2015 alone.

The number of refugees who come to the U.S. this year could also be affected by Trump’s executive order, which in addition to temporarily barring entry into the U.S. of people from seven Muslim-majority nations – Iran, Iraq, Somalia, Sudan, Syria and Yemen — also suspends refugee admissions from any country for 120 days and indefinitely bars the entry of Syrian refugees.

While Trudeau may privately find Trump’s order in opposition to values of inclusiveness and openness he campaigned upon, the Canadian leader will have little choice but to seek close cooperation with the new administration on other issues, especially trade.

Throughout his campaign, candidate Trump blasted the North American Free Trade Agreement (NAFTA), calling it a “terrible deal, a total disaster for the United States from its inception.”

As president, he has indicated he will follow up on his promise to “renegotiate” or “withdraw” from the deal.

“We’re redoing NAFTA, we’re doing a lot of our trade deals, and we’re negotiating properly with countries, even countries that are allies,” Trump said on Feb. 2. “A lot of people taking advantage of us, a lot of countries taking advantage of us, really terribly taking advantage of us.”

NAFTA, the trilateral trade agreement between Canada, Mexico, and the U.S. was negotiated by President George H. W. Bush, but passed through Congress and was signed into law under President Bill Clinton in 1994. It has gradually eliminated most tariffs on goods traded between the three countries and created one of the largest free trade zones in the world.

But ever since its implementation, the deal has been studied and debated as to how it has affected the American economy.

Studies have shown economists largely agree that NAFTA has produced benefits, which Trump say cost of American jobs.

In a 2012 survey of economic experts by the University of Chicago ’s Initiative on Global Markets, all of them said they either “strongly agree,” “agree,” or are “uncertain” that U.S. citizens have been better off with NAFTA than they would have been if the trade rules for the U.S. Canada and Mexico prior to NAFTA had remained in place. None of the experts said they “disagreed” or “strongly disagreed.”

A 2012 report from the U.S. Chamber of Commerce commended the “remarkable results of NAFTA” for the rise in U.S. commerce with Canada and Mexico.

“U.S. trade in goods and services with Canada and Mexico rose from $337 billion in 1993 to $1.182 trillion in 2011. Each day, the United States conducts over $3.2 billion in trade with its North American neighbors,” the report stated.

But while overall trade has greatly increased between the three nations, the U.S. has a significant trade deficit in goods with both of its neighbors.

In 2016, the deficit with Mexico was $63.2 billion, according to the U.S. Census Bureau. It was $11.2 billion with Canada (though the margin of that deficit is falling).

The Economic Policy Institute (EPI), a left-leaning think tank, said that the trade deficit is costing American jobs.

“By 2010, the U.S. had a trade deficit with Mexico that displaced 682,900 jobs,” EPI said in a study.

Trump has cited the U.S. trade deficit with Mexico as a reason for wanting to scrap NAFTA.

“You say, who negotiates these deals?” Trump asked crowds at a rally in Philadelphia days after his inauguration. “Not to mention, millions of jobs and thousands and thousands of factories and plants closing down all over our country.”

Trudeau, who has defended free trade, has said he is open to discussing a renegotiation of NAFTA with the U.S.

But any renegotiation will take months, if not years. So far the Trump administration has not laid out specific plans for how the deal may be changed. How it is altered will determine if Congress has to get involved.

Trump has already met with top House and Senate members who deal with financial issues including trade and tax reform. A spokesman for Trudeau confirmed in January that meetings between Canadian officials and Trump’s advisers about renegotiating NAFTA have already occurred.

During his joint press conference today with Trudeau, Trump said, “We have a very outstanding trade relationship with Canada. We will be tweaking it. We will be doing certain things that are going to benefit both of our countries.”
